Rules of the "200 mats for Polish yoga" competition

RULES OF THE COMPETITION "200 MATS FOR POLISH YOGA"


1. General information

1. The Competition is organised by JOY IN ME PAULINA NIEDZIELSKA, JAGODA SCHÄPPER SPÓŁKA CYWILNA (address of the place of business and correspondence address: ul. Ogrodowa 48/54, 00-876 Warsaw), NIP of the civil partnership 5272882838, REGON of the civil partnership 382567417, e-mail address: contact@joyinme.co, i.e.:

- Jagoda Schäpper entered into the Central Register and Information on Economic Activity of the Republic of Poland, kept by the minister responsible for economic affairs, with the following identification numbers: NIP 6751280658 and REGON 356872129; and
- Paulina Niedzielska entered into the Central Register and Information on Economic Activity of the Republic of Poland kept by the minister responsible for economic affairs, NIP 7123092902 and REGON 061411069.
(hereinafter referred to as the "Organizer").


2. These regulations (hereinafter referred to as the "Regulations") constitute the basis of the Competition conducted by the Organizer on the joyinme.co website on the public social media account @joyinme_yoga on Instagram, regulate the rules and conditions of participation in the Competition, as well as define the rights and obligations of the Participants and the Competition Organizer.
3. Participation in the Competition constitutes acceptance of the Rules. Competition participants are required to comply with the rules contained in the Rules.
4. The Competition is not subject to the provisions of the Gambling Act of 19 November 2009 (Journal of Laws of 2018, item 165, as amended).

2. Rules for participation in the competition


1. The Competition is open to individuals residing in Poland and not conducting business activity (hereinafter "Participants"). Individuals with limited legal capacity (individuals aged 13-18) may participate in the Competition only with the consent of their legal guardian. A condition for entry to the Competition is possession of all copyrights.
2. Participation in the competition and the related provision of personal data by the Participant are entirely voluntary. Participation is free of charge.
3. The competition runs from September 19, 2022, 7:00 a.m. to September 26, 2022, 11:59 p.m. Polish time.
4. The organizer reserves the right to extend the duration of the competition.
5. The competition is announced via the website www.joyinme.co and the Organizer's public account on the Instagram social networking site, available at: https://www.instagram.com/joyinme_yoga/
6. Competition entries should be sent to the dedicated email address dlajogi@joyinme.co
7. The condition for participation in the competition is:

a) answering the competition question via e-mail, i.e. “What is your favorite yoga position and why?” (Competition Task)

b) sending by e-mail a certificate of completion of a yoga teacher training course of at least 200 RYT or alternatively a certificate from a yoga school confirming teaching for at least 3 years

c) reading the Regulations and accepting their provisions.

All the above-mentioned conditions must be met by the Participant jointly.


7. The competition task may not contain content that:
a) They may have been posted with the intention of infringing the rights of third parties,
b) They may infringe any rights of third parties, including rights related to the protection of copyright and related rights,
c) They may contain offensive, vulgar content or constitute a criminal threat directed at another person,
d) They may be contrary to the interests of the Organizer,
e) They may otherwise violate the provisions of the Regulations.
By sending the Organizer a response to the competition task as part of the Competition (hereinafter referred to as the "Competition Entry"), the Participant declares that the publication of the Competition Entry does not infringe the rights or goods of third parties and consents to the processing of personal data by the Organizer for the purposes and under the conditions specified in the Regulations.


3. Competition results - Prizes and selection of winners


1. To ensure the proper conduct of the Competition, the Organizer will appoint a three-person Committee, hereinafter referred to as the Competition Committee. The Committee's responsibilities will include overseeing the proper conduct of the Competition, making decisions on all matters relating to the Competition, including the interpretation of these Rules, and selecting the Participants who will be awarded the Prizes (hereinafter referred to as the Winners). The Committee's decisions are final, which does not deprive the Participant of the right to pursue claims under the law.
2. After the end of the Competition, the Competition Committee will evaluate the Competition Task performed by the Participants and select 200 (in words: two hundred) Winners from among the Participants who, in the opinion of the Competition Committee, will perform the Competition Task most attractively.
3. The Competition winners will receive prizes: Joy in me yoga mats worth PLN 379 gross each. The prizes are exempt from personal income tax pursuant to Article 21, Section 1, Item 68 of the Personal Income Tax Act.
4. The Committee will complete the selection of Winners no later than September 30, 2022.
5. The Competition Winners will be informed of receiving the Prize by replying to the e-mail containing the Participant's application.
6. The condition for receiving the Prize is that the Winner provides the Organizer with the information necessary to deliver the Prize, including in particular: name, surname, e-mail address and correspondence address in the territory of the Republic of Poland, within 7 days from the date of sending the message by the Organizer.
7. If the Winner fails to provide the data necessary to deliver the Prize within the time limit and in accordance with the principles specified in section 6 above, the Competition Committee will select another Participant to receive the Prize.
8. The Organizer shall not be liable for failure to deliver the Prize to the Participant if the impossibility of delivering the Prize resulted solely from the Participant’s failure to provide the data required for delivery of the Prize or providing incorrect data or data inconsistent with the Regulations.
9. Each Prize will be sent once by the Organizer to the address indicated by the Winner in the territory of the Republic of Poland within 14 days from the date of sending by the Winner, in response to the information notifying about the awarded Prize, all data enabling the shipment of the Prize.
10. The Prizes are funded by the Organizer.
11. The winner may not transfer the right to the prize to a third party.
12. The Winner may waive the right to the Prize awarded to him/her by submitting an appropriate written declaration to the Organizer.
13. In the Competition, you can only receive the Prize 1 (in words: one) time.
14. The prize will be sent to the Participant at the Organizer's expense.
15. The Participant has no right to request that the Prize be exchanged for a cash prize.


4. Organizer's Rights

1. The Organizer has the right to exclude a Participant from participation in the Competition with immediate effect, as well as to refuse to award the Participant the Prize if the Participant has provided false or incomplete data required and necessary to award the Prize, in the event of failure to comply with the provisions of the Regulations, and also if the Organizer receives information about the Participant's actions contrary to the provisions of the Regulations.


5. Complaints

1. The Participant may submit any complaints related to the Competition by October 15, 2022.
2. Complaints should be submitted in writing to the Organizer's registered office address or electronically to the following e-mail address: contact@joyinme.co
In the complaint, the Participant should provide: first and last name, mailing address, email address, and a description of the reason for the complaint and the claim. The Organizer will review the complaint within 14 days of its receipt by the Organizer. A response will be sent via email to the address provided in the complaint.
4. The complaint procedure is voluntary and does not exclude the Participant's right to pursue claims through court proceedings, independent of the complaint procedure.

6. Processing of personal data

1. The personal data of the Competition Participants are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter "GDPR").
a) The personal data of the Participants are processed by the Organizer who is the Administrator of personal data processed within the Competition.
b) The Participant's personal data will be processed for the purpose of:
- conducting the Competition, which should also be understood as accepting the application for participation in the Competition, verifying the applications, selecting the winners and delivering the prize – based on the Participant’s consent (Article 6, paragraph 1, letter a) of the GDPR), expressed in the manner specified in § 2, paragraph 9 of the Regulations,
- fulfillment of tax obligations arising from the awarded prize – based on the Participant’s consent (Article 6, paragraph 1, letter a) of the GDPR), expressed in the manner specified in § 2, paragraph 9 of the Regulations, and fulfillment of obligations arising from legal provisions (Article 6, paragraph 1, letter c) of the GDPR),
- considering any complaints – based on the Participant’s consent (Article 6, paragraph 1, letter a) of the GDPR), expressed in the manner specified in § 2, paragraph 9 of the Regulations, and the implementation of the legitimate interest of the Organizer (Article 6, paragraph 1, letter f) of the GDPR),
c) You can contact the Competition Organizer via:

d) The Participant's consent to the processing of personal data for the purpose of participating in the Contest is voluntary. However, it is necessary for the Participant to participate in the Contest and receive the prize. The Participant has the right to withdraw their consent at any time by sending a message to: contact@joyineme.co
Withdrawal of consent does not affect the lawfulness of the processing of the Participant's data carried out before its withdrawal.
e) The Organizer will retain Participant's personal data for the period necessary to fulfill all obligations imposed by these Rules, including tax obligations related to awarding the prize and the expiration of any claims that Participants may have in connection with the Competition. The limitation period for claims is specified in the provisions of the Civil Code.
f) The Participant's personal data may be transferred to companies to which the Organizer commissions the performance of activities during the organization of the Competition, on the basis of a personal data processing agreement, in particular the mailing company handling the competition and the e-mail hosting service provider through which the Organizer collects applications.
g) Participants have the right to access their personal data and to have it rectified, amended, or deleted, as well as the right to request the restriction of data processing, and the right to data portability in the situations specified in the GDPR. They may also object to the processing of their personal data.
h) If the Participant considers that his/her personal data is being processed during the Competition in breach of the law, he/she may file a complaint with the President of the Personal Data Protection Office.
j) Personal data of third parties were provided to the Organizer by the Participant, based on the expressed consent of the third party.
k) All decisions regarding the course of the Competition will be made only in the manner specified in § 3 section 1 of the Regulations.
